Hourly pay in North Dakota

North Dakota's minimum wage is $7.25 an hour, set in state law from July 24, 2009. Tipped employees — those who get more than $30 a month in tips — can be paid $4.86 an hour in cash. That is a tip credit of 33% ($2.39), and tips plus wages must reach $7.25.

Overtime. State rules require time-and-a-half for hours over 40 in a week. There is no daily overtime rule, and paid leave does not count toward the 40 hours.

Tips and overtime on your North Dakota tax. Reported tips and overtime pay are part of your wages for the withholding table.

Because hours change from week to week, your withholding changes too: a week with lots of overtime is withheld as if you earned that much every week, so more comes out. It usually evens out when you file your return.

What comes out of a North Dakota paycheck

North Dakota has a graduated income tax with two rates, 1.95% and 2.5%, above a first slice of pay with no tax. For a federal W-4 from 2020 or later, employers use the Office of State Tax Commissioner's annual table:

  1. Start with your pay subject to income tax for this paycheck — after a traditional 401(k) and pre-tax health insurance.
  2. Multiply it by the number of paychecks in a year to get your yearly pay.
  3. Find that yearly pay in the table for the filing status on your federal W-4. Pay up to the first row has no tax. Above it, 1.95% of the amount over the row's start; in the top row, a fixed amount plus 2.5%.
  4. Divide the yearly amount by the number of paychecks and round to the nearest whole dollar.

The only state line in this calculator for a North Dakota paycheck is income tax.

Tips and overtime in 2026

New federal deductions apply for 2025 through 2028: up to $25,000 for qualified tips, and up to $12,500 ($25,000 for joint filers) for the extra "half" of time-and-a-half overtime. Both phase out above $150,000 of income ($300,000 joint).

These are deductions on your tax return. Your employer still takes Social Security and Medicare out of tips and overtime, and still withholds income tax unless you tell it otherwise. If you expect to claim them, you can put the expected amount in Step 4(b) of your W-4 (and in the Step 4(b) box above) so less income tax is withheld during the year.
